Clear provisions

In practice, a distinction is already made between audits of public companies and economically significant companies on the one hand and audits of small and medium-sized enterprises on the other. The new regulation brings clear legal provisions for this distinction.

Now it is no longer the legal form that determines whether a legal entity must have an auditor, but the size and importance of a company. The new provisions on mandatory auditing apply to public limited companies, associations and foundations. The auditing obligation still does not apply to partnerships.

A distinction is now made between "ordinary audit" and "limited audit". SMEs that do not exceed certain size criteria can benefit from a limited audit compared to the ordinary audit. This offers small companies the advantage that the effort and costs for the audit are kept within reasonable limits.
